Please read these Terms and Conditions carefully before using our services. By booking or participating in any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Definitions

For the purposes of these Terms and Conditions:

  • “Company”, “We”, “Us”, or “Our” refers to Swasthya with Nehal, a business registered in the Netherlands with KVK number: 97796964.
  • “Client”, “You”, or “Your” refers to the individual accessing or using our services.
  • “Services” refers to all yoga, physiotherapy, and wellness services offered by the Company, including but not limited to PhysioYoga, therapeutic yoga, pre-natal and post-natal yoga sessions.
  • “Session” refers to an individual yoga or physiotherapy class or consultation.
  • “Package” refers to a bundle of multiple sessions purchased together at a discounted rate.
  • “Website” refers to our website accessible at the current domain.
  • “Online Services” refers to services delivered remotely via video conferencing platforms such as Zoom.
  • “In-Person Services” refers to services delivered physically at our location in Rotterdam, the Netherlands.

2. Acceptance of Terms

By accessing our website, booking a consultation, purchasing a package, or participating in any session, you confirm that:

  • You are at least 18 years of age, or have obtained parental/guardian consent if you are a minor.
  • You have read and understood these Terms and Conditions.
  • You agree to comply with all terms outlined herein.
  • You accept our Privacy Policy.

If you do not agree with any part of these Terms, you must not use our services.

3. Services Offered

3.1 Service Categories

We offer the following wellness services:

Power Mama (Pre & Post-Natal Yoga)

  • Online 1:1 sessions via Zoom
  • Online group sessions via Zoom
  • Designed for pregnancy preparation, post-natal recovery, and motherhood wellness

Therapeutic PhysioYoga

  • Online 1:1 sessions via Zoom
  • In-person 1:1 sessions in Rotterdam
  • Designed for stress management, chronic pain relief, PCOS management, and general fitness improvement

3.2 Session Formats

  • 1:1 Sessions: Individual, personalized sessions tailored to your specific needs
  • Group Sessions: Multiple participants in a shared class environment
  • Online Sessions: Conducted via Zoom or similar video conferencing platform
  • In-Person Sessions: Conducted at our studio location in Rotterdam

4. Pricing and Packages

4.1 Package-Based Pricing

Our services are offered through package-based pricing. Each package includes:

  • A specified number of sessions
  • A validity period during which sessions must be used
  • Potential savings compared to individual session pricing

4.2 Current Pricing

Please refer to our website or contact us directly for current pricing information. All prices are stated in Euros (€) and include BTW (VAT) where applicable.

4.3 Price Changes

  • All prices are subject to change without prior notice.
  • Price changes will not affect packages already purchased.
  • We reserve the right to modify package offerings, pricing structures, and promotional discounts at our discretion.

5. Payment Terms

5.1 Advance Payment Requirement

100% advance payment is required for all package purchases. No services will be provided until full payment is received.

5.2 Payment Methods

We accept payments through our designated payment processors. Payment methods may include:

  • Bank transfer
  • Online payment platforms
  • Credit/debit cards (where available)

5.3 Payment Confirmation

Upon receipt of payment, you will receive a confirmation email with:

  • Package details
  • Number of sessions purchased
  • Validity period
  • Booking instructions

6. Refund and Cancellation Policy

6.1 No Refund Policy

All payments are non-refundable. Once a package is purchased and payment is received, no refunds will be issued under any circumstances, including but not limited to:

  • Change of mind
  • Inability to attend sessions
  • Relocation
  • Health conditions preventing participation
  • Dissatisfaction with services

6.2 Dutch Consumer Law Exception

Under Dutch consumer protection law (Wet bescherming consument op afstand) and the EU Consumer Rights Directive (2011/83/EU), you may have a 14-day cooling-off period for distance contracts. However, this right is explicitly waived when you request that services commence during this period. By booking your first session within 14 days of purchase, you acknowledge and agree that you forfeit your right of withdrawal.

6.3 Session Rescheduling

Individual sessions may be rescheduled subject to the following conditions:

  • 24-hour advance notice is required for rescheduling
  • Rescheduling requests made with less than 24 hours’ notice will result in the forfeiture of that session
  • Sessions must be rescheduled within the package validity period
  • Rescheduling is subject to availability

6.4 Missed Sessions

  • Sessions missed without proper notice (24-hour advance) will be forfeited and counted as used
  • No makeup sessions will be provided for missed sessions
  • No extensions to package validity periods will be granted for missed sessions

7. Package Terms

7.1 Validity Periods

Each package has a specified validity period during which all sessions must be completed:

  • The validity period begins on the date of purchase
  • Sessions not used within the validity period will expire and be forfeited
  • No extensions to validity periods will be granted under any circumstances
  • No refunds will be provided for unused sessions

7.2 Non-Transferability

  • Packages are personal and non-transferable
  • Sessions cannot be shared, gifted, or transferred to another individual
  • Packages cannot be resold or exchanged for cash value

7.3 Package Modifications

  • Package contents, session numbers, and validity periods cannot be modified after purchase
  • Upgrading or downgrading packages is not permitted
  • Combining sessions from multiple packages is not permitted

8. Health and Medical Disclaimers

8.1 Not Medical Treatment

IMPORTANT: Our services are complementary wellness practices and are NOT a substitute for professional medical diagnosis, treatment, or advice:

  • We do not diagnose, treat, cure, or prevent any disease or medical condition
  • Our services are designed to support general wellness, stress reduction, flexibility, and strength
  • You should not rely on our services as a replacement for professional medical care

8.2 Medical Consultation Required

By participating in our services, you confirm that:

  • You have consulted with a qualified healthcare provider before beginning our program
  • You have disclosed all relevant medical conditions, injuries, and health concerns
  • You have received medical clearance to participate in physical activity and yoga
  • You will immediately inform us of any changes to your health status

8.3 Pre-Natal and Post-Natal Specific Disclaimers

For Power Mama (Pre & Post-Natal) services, you additionally confirm that:

  • You have consulted with your obstetrician, midwife, or doctor before participating
  • You have been cleared for physical activity during pregnancy or post-partum
  • You will immediately inform the instructor if you experience any pain, discomfort, dizziness, or unusual symptoms
  • You understand that certain movements may be contraindicated during pregnancy

8.4 Assumption of Risk

You acknowledge and accept that:

  • Participation in physical activities carries inherent risks
  • You participate voluntarily and at your own risk
  • You are responsible for your own safety and well-being during sessions
  • You will not exceed your personal physical limitations
  • You will inform the instructor immediately if you experience pain or discomfort

8.5 Contraindications

You should NOT participate in our services if you have:

  • Uncontrolled high blood pressure
  • Recent surgery or injuries without medical clearance
  • Severe osteoporosis
  • Acute illness or infection
  • Any condition contraindicated for physical activity without medical supervision

If you are unsure, please consult your healthcare provider before booking.

9. Participant Responsibilities

9.1 Disclosure Requirements

You must:

  • Provide accurate and complete health information
  • Disclose all relevant medical conditions, injuries, and medications
  • Update us promptly if your health status changes
  • Inform the instructor before each session of any recent injuries or health changes

9.2 Session Participation

During sessions, you must:

  • Follow instructor guidance and modifications
  • Listen to your body and rest when needed
  • Inform the instructor immediately if you experience pain or discomfort
  • Not exceed your personal physical limitations
  • Ensure you have adequate space, proper flooring, and a stable internet connection (for online sessions)

9.3 Equipment and Environment

For online sessions, you are responsible for:

  • Providing a safe, clear practice space
  • Having a stable internet connection
  • Having a working camera and microphone
  • Having any recommended props (yoga mat, blocks, straps, etc.)

For in-person sessions, you must:

  • Arrive on time
  • Bring your own yoga mat (unless otherwise specified)
  • Inform reception of any health concerns before the session

10. Instructor Rights

We reserve the right to:

  • Refuse service to any individual
  • Modify or cancel sessions with reasonable notice
  • Terminate your participation if you violate these Terms
  • Exclude you from sessions if your behavior is disruptive or inappropriate
  • Request updated medical clearance if we have safety concerns

11. Intellectual Property

11.1 Ownership

All content, materials, session plans, videos, handouts, and intellectual property provided during our services remain the exclusive property of Swasthya with Nehal.

11.2 Usage Restrictions

You may not:

  • Record, photograph, or screenshot sessions without express written permission
  • Share, distribute, or reproduce any materials provided
  • Use our content for commercial purposes
  • Teach or replicate our proprietary sequences or methods

11.3 Personal Use Only

Any materials provided to you are for your personal use only and may not be shared with third parties.

12. Privacy and Data Protection

12.1 GDPR Compliance

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and the Dutch implementation (Algemene Verordening Gegevensbescherming - AVG).

12.2 Health Data

We may collect and process health-related information necessary for providing safe and effective services. Such data is considered special category data under GDPR Article 9 and is processed only with your explicit consent and for the purpose of service delivery.

13. Limitation of Liability

13.1 Service Provision

To the maximum extent permitted by Dutch law:

  • Our services are provided “as is” without warranties of any kind
  • We do not guarantee specific results or outcomes
  • We are not liable for failure to achieve particular fitness or health goals

13.2 Liability Cap

Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you for the specific package in question.

13.3 Exclusions

We shall not be liable for:

  • Any indirect, consequential, or incidental damages
  • Personal injury resulting from failure to follow instructions or disclosure requirements
  • Loss or damage to personal property
  • Technical issues with third-party platforms (e.g., Zoom)
  • Interruptions due to circumstances beyond our control (force majeure)

13.4 Your Responsibility

You acknowledge that you are solely responsible for:

  • Your decision to participate in our services
  • Any injuries or health issues arising from your participation
  • Ensuring you have appropriate medical clearance
  • Following safety instructions and guidelines

14. Technical Requirements (Online Services)

For online sessions, you must ensure:

  • A stable internet connection (minimum 10 Mbps recommended)
  • A device with working camera and microphone
  • Zoom or specified video conferencing software installed and functional
  • Adequate lighting for the instructor to see your form
  • Sufficient space to move safely

We are not responsible for technical issues, poor connection quality, or inability to participate due to your equipment or internet service.

15. Communications and Support

15.1 WhatsApp/Email Support

Certain packages include WhatsApp or email support between sessions. This support:

  • Is provided within reasonable limits
  • Is not available 24/7
  • Is for questions related to your program, not emergency medical advice
  • May have response time delays
  • Can be withdrawn if misused or abused

15.2 Emergency Contact

For medical emergencies, always contact emergency services (112 in the Netherlands). Do not contact us for urgent medical issues.

16. Governing Law and Jurisdiction

16.1 Applicable Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Netherlands.

16.2 Jurisdiction

Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.

16.3 EU Consumer Rights

If you are a consumer resident in the European Union, you benefit from mandatory consumer protection provisions under EU law and the law of your country of residence.

17. Dispute Resolution

17.1 Informal Resolution

If you have any concerns or disputes, we encourage you to contact us first to attempt informal resolution.

17.2 Mediation

Before initiating legal proceedings, both parties agree to attempt mediation through a recognized Dutch mediation service.

18. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Pandemics or public health emergencies
  • Government restrictions or lockdowns
  • Internet or power outages
  • Acts of war or terrorism

In such events, we will make reasonable efforts to notify you and reschedule sessions where possible, but no refunds will be provided.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

20. Amendments

20.1 Right to Modify

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective when posted on our website with an updated “Last updated” date.

20.2 Notification

For material changes, we will make reasonable efforts to notify you via email or through a prominent notice on our website.

20.3 Continued Use

Your continued use of our services after changes are posted constitutes your acceptance of the modified Terms.

20.4 Existing Packages

Changes to Terms will not affect the core terms (pricing, validity, refund policy) of packages already purchased.
